Joshua N. Rose, joined the Law Offices of David L. Rose in 1989 and became a named member of the firm in 1995.  I have played a leading role in the firm's hiring, finances, advertising, ethics, case selection and case prosecution for over 10 years.

 

I have twenty one years of experience in all phases of litigation from client and case development through petitions for certiorari.  I have managed cases ranging in size from small claims and administrative actions through multi-million dollar actions involving hundreds of plaintiffs, tens of thousands of documents and co-ordination among several law firms.  I have represented plaintiffs and defendants ranging in size from individuals to large organizations and certified classes.  I have appeared in federal and state trial courts in California, Connecticut, the District of Columbia, Illinois, Indiana, Maryland, Michigan, Missouri, New Jersey, New York, North Carolina, Ohio, Texas, Virginia and West Virginia.  I have argued appeals in the U.S. Courts of Appeal for the Second, Third, Fourth, Seventh and DC Circuits. I have briefed issues in the areas of employment discrimination, employment contracts, insurance policy claims, unfair trade practices, ERISA, clean water, clean air, bankruptcy, toxic tort, false claims act (qui tam), CERCLA, RCRA, public contracting, RICO, Section 1983, commercial contracts and all phases of civil and appellate procedure.

Rose & Rose, together with Brian Abeles, joined together with a goal of forming a unique boutique law practice in 2008, now known as Equitas Disability Advocates, LLC, the primary focus and objective of this firm is to represent the rights and interests of Individuals, businesses and professionals that are in the position of pursuing disability benefit and insurance coverage claims, addressing what are unquestionably most serious concerns about obtaining the rightful entitlements of claimants from the perspective of providing both claims consulting services and legal representation against the insurers.

 

A primary objective and concept of this new firm was to bring together over thirty-five years of disability benefits experience and capabilities as well as having access to an exceptional and extraordinary array of intellectual property resources associated with the disability benefits field.  

 

Representative Cases: 

  • Welch v Eli Lilly & Co. (SD Indiana, pending) - Race discrimination claim for class of 1,500 African Americans.  Includes 150+ named class representatives
  • Harvey v MetLife (S.Ct. Manhattan - pending) - One of two deceptive trade practices class claims relating to overcharges on childrens’ term riders to life insurance policies.
  • Fischel v. The Equitable Life Assurance Society of the United States (ND Cal.) Co-counsel for plaintiffs in a nationwide ERISA class action seeking health insurance benefits for approximately 5,000 life insurance salespeople. Seven figure cash settlement plus injunctive relief to pay health insurance for life.
  • New Haven Branch, NAACP v. East Haven, 70 F.3d 219 (2d Cir. 1997) - One of a series of 40+ Title VII actions known as the “Suburban litigation Program” seeking to end residence preferences and open employment opportunities in suburban towns to African Americans living in the inner cities.
